By using this Website you agree to be bound by these Terms and Conditions, which must be read every time the Website is visited, since both the Website and these conditions are subject to changes.

Except as expressly authorized by The Plastic Surgery Center of Buenos Aires, you agree not to modify, copy, rent, lease, loan, sell, distribute or create derivative works based on the site in whole or in part.

Users who find inappropriate content should contact us immediately at info@surgeryba.com in order that it may be considered for removal. In addition, we reserve the right to remove all material that we consider inappropriate. The purpose of the Website is to display basic data about the different medical procedures and provide general information about the treatments. Particular cases shall be evaluated by physicians.

The information obtained from this Website cannot be used to determine whether or not you will have the procedure carried out, nor is it a guarantee of the results or any outcome of the procedure/s you decide to undergo. During the consultations, your surgeon/professional will explain to you in detail how a particular procedure applies to your individual condition.

The information obtained from this Website is for your information only. Individual results may vary. The references are not a guarantee of particular results. The Plastic Surgery Center of Buenos Aires reminds you that all surgeries carry risks of complications, which in case of cosmetic/plastic surgery, includes dissatisfaction with the results.

Any use or changes made in the information with a purpose different from those set forth in these Terms and Conditions shall be regarded as a violation of International Copyright Laws protecting Intellectual Property Rights.

3. Personal Data
The user shall be able to access the information in the Website without providing any personal data. However, should the user make any consultation via e-mail, in which case a form must be completed, the personal information provided therein shall be included in a file, to be use only by The Plastic Surgery Center of Buenos Aires, and which purpose is to furnish the information requested, benefiting from the advantages associated to filling in said form and sending the user business offers adjusted to specially fit his/her profile, whether by mail or electronic channels (e-mail).

All personal data filled in by the users in the Website through the form(s) shall not be shared or redistributed to third parties.

It is worth mentioning that the information regarding different pages visited in the Website, time of navigation and downloads may also be anonymously obtained only for statistical purposes, in order to improve the rendering of services and carry out basic administration tasks.

The Plastic Surgery Center of Buenos Aires shall be hold harmless for the damages derived from the unlawfulness, quality, unavailability, error and uselessness of the Linked Sites, or any other damage that were not directly attributed to The Plastic Surgery Center of Buenos Aires.

5. Minors
Any person under 18 years old needs the express consent of their parents or guardian before submitting their personal data to The Plastic Surgery Center of Buenos Aires via the Website. The Plastic Surgery Center of Buenos Aires shall assume that if the minor accesses the Website is under given authorization of their parents, guardian or legal representative.

6. Acceptance of Terms and Conditions of Use of the Website
The User undertakes to use the Portal and services as provided by law and these Terms and Conditions, as well as generally accepted moral and good customs and public order, being liable against The Plastic Surgery Center of Buenos Aires or third parties for damages that may be caused as a consequence of the non-fulfillment of said obligation.

Service Terms and Conditions

The Plastic Surgery Center of Buenos Aires

1. Application for Treatment/Procedure
Patients' applications sent via our web site or requested by phone call are received by The Plastic Surgery Center of Buenos Aires' International Patient Information Center. Our advisors are trained to answer general questions about the procedures and terms of the service. If the patient has questions related to medical issues, the advisor will pass the questions on to the professional and the answers back to the patient.

2. Quotations
The amount established by The Plastic Surgery Center of Buenos Aires on the first stage is an estimate. The final amount will be confirmed by the advisors. It is important to insist that the original estimate may be modified after the personal evaluation carried out by the professional, once the patient has arrived in Buenos Aires.

All exchange with the Patient Information Center is free of charge and it does not represent any kind of agreement between The Plastic Surgery Center of Buenos Aires and the patient.

3. Items Included in the Quotation
The quotation for a standard medical trip includes: a) accommodations for the stated period at the agreed guest house, hotel, leased home/apartment or bed & breakfast establishment; b) pre-operative and post-operative consultations with your chosen surgeon, the Procedure/surgery, hospital/clinic accommodations, anesthesiologist fees, pathology, radiology, physiology and hospital drugs; c) a trained hospitality staff member who will meet you on arrival and accompany you to and from medical consults and to the surgery; d) all transfers to and from the airport and to your surgical and medical appointments; e) a comprehensive personalized schedule of medical, dental, surgical appointments, nurse visits and tourist activities; f) comprehensive pre-surgical medical consultations and examinations; g) follow-up visits to your surgeon and monitoring; h) any additional services booked with your reservation (trips, spa or relaxation treatments, etc.)

The above mentioned services may vary according to the treatment package, which is customized for each patient. Each package is designed to meet the requirements of each patient.

Please note that the following are not included: a) airfare to and from Argentina. However, we will be pleased to organize it through our travel agents; b) tours and excursions (unless requested at the time of booking); c) medications required for conditions outside the area of your surgery and any medications prescribed following your surgery. Please bring along all currently prescribed medications you take regularly in sufficient quantity to cover your stay. A copy of your prescriptions and medical antecedents should be in your possession at all times; d) the quoted fee you will receive does not include meals not specified in your accommodations nor items of a personal nature, including telephone calls. However a cell phone will be provided for your exclusive use during your stay (subject to availability); e) costs due to unforeseen complications which may arise from the surgery or any other causes. These are not limited to but may include extra hospital stay, consultations with other specialists, physicians, airline penalties, etc. f) additional transportation for accompanying persons, personal activities, etc.; g) any other item not specified in the quotation.

4. Reservations
Once the date for the trip and all the details concerning the medical services have been agreed upon, the patient shall pay 50% of the package's total cost by way of reservation. Once the payment has been made, the patient will be referred to the International Patient Care Center.

Once the patient has made the deposit, the cost of the package will be valid for 3 months. If the patient decides to take the medical trip after the 3 month period, the remaining package´s cost then will be charged according to the pricing existing at the time of taking the trip.

However, if the patient wishes to maintain the initial cost and travel after the 3 month period, he/she shall pay the whole package's cost before such period expires.

5. Before the Trip
The Plastic Surgery Center of Buenos Aires and the International Patient Care Center advisors will be in charge of planning the medical trip. The advisors will ask the patient for his/her medical record and related information in order to evaluate whether the patient is fit for undergoing the treatment required.

Any and all medical information delivered by the interested patient shall be evaluated by The Plastic Surgery Center of Buenos Aires' Medical Department, which must validate such application in order to receive the requested treatment. In addition, The Plastic Surgery Center of Buenos Aires' Medical Department reserves the right to ask for additional medical information from both the patient and his/her personal physicians abroad.

The interested patient has the right to safeguard his/her identity and medical information, upon prior notice. In the event that the patient wishes to keep secret all medical information shared with The Plastic Surgery Center of Buenos Aires' Medical Department, he/she must expressly state so in writing for The Plastic Surgery Center of Buenos Aires to instruct all necessary mechanisms for protecting said information.

6. Planning the Medical Package
The detailed plan of the medical trip may be modified. Some procedures cannot be carried out together. All requested procedures may be subject to changes according to the diagnosis and at the discretion of the physician, also taking into consideration the recommendations of the personal physician of the patient.

7. Preexisting Diseases
Patients with preexisting diseases will have to make an extra deposit (apart from the package) that will be used for the specific analysis required by his/her condition or for hiring specialized medical staff to assist the patient during the procedure.

The deposit will be reimbursed to the patient if no extra services related to his/her preexisting condition are needed.

8. Unforeseen Complications
If the compulsory medical studies show that the patient suffers from a preexisting condition or disease that may interfere with the procedure but of which the patient has no previous knowledge: a) the patient will be informed about his/her medical condition and about the possible consequences the procedure will have on his/her health; b) the patient will have to pay a deposit (apart from the package) that will be used for specific analysis or for hiring specialized medical staff; c) the deposit will be reimbursed to the patient if no extra services related to his/her preexisting condition are needed.

The Plastic Surgery Center of Buenos Aires, and all professionals involved, will not perform any procedure that might have negative effects on the patient's health without taking all the necessary precautions.

9. Confirmation of the Dates
The International Patient Care Center will confirm by e-mail the consultation and treatment dates. The patient will have to make the payment of the remaining 50%, 15 days before the trip.

If the patient does not pay the remaining 50% of the package at the indicated date, the reservations will not be kept. Once the payment is received, the dates will be assigned according to availability.

10. Arrival in Buenos Aires
The patient will arrive at the Ezeiza International Airport (EZE). An assistant will receive the patient and take him/her to the hotel where he/she will stay. The patient will be given a Welcome Kit in which he/she will find the trip's schedule, as well as detailed documentation about the procedures that he/she will have to sign before the treatment.

The assistants we provide are not exclusive, they are assigned according to availability, that is, one assistant will receive you at the airport whereas another will go with you to the medical consultation.

It is possible for the patient to ask for an exclusive assistant, but this service has an additional cost.

11. First Consultation
After the first consultation with the physician, the date and time for the treatment will be confirmed. If on the first consultation the need for additional procedures arises, the International Patient Care Center advisors will prepare a new quotation.

Before the surgery, the patient will have to sign a document, or Informed Consent form, stating that he/she knows the risks implied and the possible complications that may arise.

12. Follow-up
After the procedure, the physician will set appointments for the follow-up care and will inform the patient about the special precautions he/she will have to take when he/she returns home.

13. Departure
The patient will be taken to the airport by an assistant on the day of his/her departure.

14. After the Trip
The International Patient Care Center advisors will get in touch with the patient to check on his health and well-being.

15. Cancellation Policy
Cancellation of the Trip Before Traveling: if the patient decides to cancel the trip after having paid the deposit: a) The deposit will not be returned under any circumstance. However, the patient may use the amount as a credit; b) this credit will expire in 6 months.

Cancellation of the Trip After having paid the total package's cost: a) The patient will be returned the remaining percentage of the package's total cost (the deposit will not be returned under any circumstance); b) the patient can use the amount paid as a credit, that is, postpone the trip. This credit will expire in 6 months.

16. Cancellation of the service once in Argentina
If, once in Argentina, the patient decides not to undergo the procedure requested, he will be reimbursed the amount corresponding to the procedure, excluding the deposit and the expenses incurred.

If the professional advises the patient not to undergo the procedure he/she requested due to medical reasons, the patient will be reimbursed the amount corresponding to the procedure, excluding the deposit and the expenses incurred.

The patient will be informed about the expenses incurred. If special supplies were bought for the patient (prostheses or bandages, for example), he/she can take them with him/her.

In none of these cases the refund includes administrative costs of canceling the services or in which the company may have incurred.

17. Rescheduling
If the patient must postpone the trip due to personal reasons after the deposit was made, he/she may ask for a reschedule.

The Plastic Surgery Center of Buenos Aires will maintain to the original quoted price for 3 months after the date in which the trip was postponed, but once that period elapses, the package's price could be modified.

The deposit will be held and considered as payment on account. The patient may ask for a rescheduling of the consultation dates only twice.

18. The Plastic Surgery Center of Buenos Aires' Responsibility
YOU AGREE THAT UNDER NO CIRCUMSTANCES WILL THE PLASTIC SURGERY CENTER OF BUENOS AIRES OR ANY THEIR DIRECTORS, OFFICERS, MEMBERS, EMPLOYEES, AGENTS, REPRESENTATIVES, SERVANTS, ATTORNEYS, PREDECESSORS, SUCCESSORS OR ASSIGNS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOST PROFITS AND DAMAGES THAT RESULT FROM INCONVENIENCE, DELAY, OR LOSS OF USE) ARISING OUT OF USE OF SERVICES RENDERED, ANY FURNISHED MATERIALS OR PRODUCTS, ARRANGEMENTS MADE BASED ON INFORMATION OBTAINED ON OR THROUGH THE PLASTIC SURGERY CENTER OF BUENOS AIRES OR THIRD PARTIES, EVEN IF WE OR THEY HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW The Plastic Surgery Center of Buenos Aires assumes no responsibility nor does it grant any warranties, expressed or implied relating to the operation, safety, condition or service of any physician, health care provider,consultant, hospital, clinic, aircraft, motor vehicle, boat, other conveyance, inn, lodge, apartment, or hotel and/or products associated with such entities or services, such as tourist activities or restaurants, that are used wholly or in part by, for or on behalf of you. We are not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom. The medical team and its staff assume full responsibility. The patient will not hold The Plastic Surgery Center of Buenos Aires responsible. The Plastic Surgery Center of Buenos Aires, as facilitator and third party payment guarantee while acting in your best interests at all times, cannot be held liable for any medical complications resulting in personal losses including death or dissatisfaction with medical results.

The Plastic Surgery Center of Buenos Aires is not the healthcare provider, hospital or clinic, a transportation provider, travel agent, or hotelier. Therefore, The Plastic Surgery Center of Buenos Aires is not responsible in any manner whatsoever for any deficiency, delay, defect, error or any other shortcomings at the hospitals, airlines, and hotels or any other services arranged on your behalf.
The surgeon and the clinic are legally responsible for the medical part of the process. You will enter a contract for your medical treatment directly with the practitioner(s) involved.

As a result, neither The Plastic Surgery Center of Buenos Aires, nor its directors or officers or employees shall be liable in any way, and you shall be deemed to have indemnified the said parties against any liability, loss, injury, damage, claims or proceedings of any nature whatsoever and howsoever arising out of or in connection with any services rendered by any of the parties to you or in respect of any act or omission on the part of the said parties, whether as a result of negligence (including gross negligence) or omission.

Further, The Plastic Surgery Center of Buenos Aires, its directors, employees and officers shall not be liable in respect of the negligence (including gross negligence) of any medical practitioner to whom you have been referred.

The parties indemnified above shall not be liable for any consequential, indirect, special, punitive or exemplary damages, including but not limited to loss of profit, revenue, or product which you or any party claiming through you may suffer.

In case of disagreement, the surgeon is only liable if litigation takes place in Argentina under Argentine law. Any medical or surgical advice provided through the The Plastic Surgery Center of Buenos Aires' Website, even if accurate to the best of our knowledge, should be discussed with your surgeon.

In case of medical discrepancy or conflict for immutability of malpractice carried out by the patient, the parts establish and agree that all judicial action must be carried out by the patient towards the surgeon/professional within the jurisdiction of the City of Buenos Aires of the Republic of Argentina, and that action will not be extended towards The Plastic Surgery Center of Buenos Aires, since it is a company that puts at the disposition of the patient different professional option without exercising medicine professionally.

If complications arise that will require additional interventions or extended hospitalization, the cost will be established by The Plastic Surgery Center of Buenos Aires and paid by the patient.

Neither The Plastic Surgery Center of Buenos Aires, nor the physician chosen by the patient and the medical team, shall be responsible for any medical situation that may occur during the patient's stay, in which they have failed to take part or make any decision whatsoever.

It is understood that, in plastic surgeries, there exists the possibility of discrepancies between the surgeon and the patient as regards the aesthetic results. It is understood that the physician will do his best to obtain the results that will best satisfy the patients expectations. In the case of any unresolved dispute between you and your surgeon, you are encouraged to seek arbitration. In the event of litigation the registered medical practitioners, hospitals and clinics would defend themselves only in Argentine courts.

These conditions (including the guides and rules referred to herein) constitute the entire agreement, superseding any prior agreements between you and The Plastic Surgery Center of Buenos Aires (including its providers and affiliates). Any failure by The Plastic Surgery Center of Buenos Aires (including its providers and affiliates) to exercise or enforce any right or provision of the conditions (Terms of Service) shall not constitute a waiver of such right or provision. If any provision of the conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Conditions remain in full force and effect.
